Terms of Service
Please read these Terms of Service ("Terms") carefully before using the BrewERP platform at brewerp.top. By accessing or using BrewERP, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using BrewERP, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. These Terms apply to all users, including free trial users, paid subscribers, and self-hosted licensees.
2. Description of Service
BrewERP is a cloud-based enterprise resource planning (ERP) software designed for craft breweries and boutique wineries. The service includes production tracking, inventory management, order processing, financial reporting, and related features, delivered as a software-as-a-service (SaaS) via web browser.
We also offer a self-hosted license that allows you to deploy BrewERP on your own infrastructure.
3. Account Registration
To use BrewERP, you must create an account by providing accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access at sales@brewerp.top
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization.
4. Free Trial
New accounts receive a 14-day free trial with full access to all features. No credit card is required to start. At the end of the trial period, your account will be restricted until you upgrade to a paid plan. Trial data is preserved during the restriction period for 30 days.
5. Subscription Plans and Billing
Paid subscriptions are billed monthly or annually in advance. Prices are as listed on our pricing page and may change with 30 days' notice.
- Starter: $29/month — up to 3 users, 50 products
- Pro: $79/month — up to 10 users, 200 products, advanced reports, bank sync
- Business: $149/month — unlimited users and products, API access
Payments are processed through Cryptomus. By making a payment, you agree to Cryptomus's payment terms. All payments are non-refundable except as required by applicable law or at our sole discretion.
6. Self-Hosted License
Self-hosted licenses grant you a non-exclusive, non-transferable license to deploy and use BrewERP on your own servers for the duration specified. The license includes:
- Access to the full source code for deployment purposes
- One year of software updates and security patches
- Installation support
You may not sublicense, resell, or distribute the software. After the first year, you may continue using the software without updates, or renew at the then-current renewal price.
7. Acceptable Use
You agree to use BrewERP only for lawful purposes and in accordance with these Terms. You must not:
- Use the service for any illegal activity or to facilitate illegal activity
- Attempt to gain unauthorized access to any part of the service or other user accounts
- Upload or transmit malware, viruses, or harmful code
- Reverse engineer, decompile, or disassemble the software (except as permitted by self-hosted license)
- Use the service to send spam, unsolicited messages, or conduct fraudulent activity
- Overload or disrupt the service infrastructure (denial of service attacks)
- Resell or white-label the cloud service without written permission
8. Your Data
You retain ownership of all data you enter into BrewERP (production records, customer data, financial data, etc.). By using the service, you grant us a limited license to store and process your data solely for the purpose of providing the service to you.
We will not access your business data except to provide support when explicitly authorized by you, or when required by law.
You are responsible for the accuracy, legality, and appropriateness of your data. You should maintain your own backups of critical data.
9. Service Availability
We strive to maintain 99.9% uptime for the cloud service. However, we do not guarantee uninterrupted availability. Scheduled maintenance will be announced in advance when possible. We are not liable for losses arising from service interruptions beyond our reasonable control.
10. Intellectual Property
BrewERP and its original content, features, and functionality are owned by us and protected by intellectual property laws. The BrewERP name, logo, and brand are our trademarks.
Nothing in these Terms transfers ownership of BrewERP intellectual property to you. The self-hosted license grants usage rights only, not ownership.
11. Limitation of Liability
To the maximum extent permitted by law, BrewERP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the service.
Our total liability to you for any claims arising from these Terms or your use of the service shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
12. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or uninterrupted.
13. Termination
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your account if you violate these Terms, fail to pay, or for other valid business reasons, with reasonable notice where possible.
Upon termination, you will lose access to the service and your data will be deleted after a 30-day grace period (except as required by law).
14. Changes to Terms
We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the jurisdiction where our company is registered, without regard to conflict of law provisions. Any disputes shall be resolved through good-faith negotiation first; if unresolved, through binding arbitration or the courts of competent jurisdiction.
